Terms & Conditions


These terms and conditions constitute the full and complete service agreement (the "Agreement") between you (the "Customer") and Stradbroke Carpets, of Dunwich, QLD 4183 Australia for the provision of services by Stradbroke Carpet & Upholstery Cleaning. The term ‘Materials’ as referred to in the terms and conditions refers to all things (e.g. rugs, carpets, upholstery, stairs, etc.) that are to be or have been cleaned by Stradbroke Carpet & Upholstery Cleaning
Customers must review this Agreement BEFORE allowing cleaning Services to be undertaken by Stradbroke Carpet & Upholstery Cleaning. The use of Stradbroke Carpet & Upholstery Cleaning services constitutes the Customers’ acceptance of the terms and conditions set out on the website www.stradbrokecarpets.com.au

Carpet and Upholstery Cleaning Services
• Subject to the terms of this Agreement, Stradbroke Carpet & Upholstery Cleaning agrees to provide carpet and upholstery cleaning services (the "Service") to the Customer at an address specified by the Customer (the "Service Site").
• The Service Site will be for such carpet cleaning and upholstery cleaning services as agreed with the Customer at the time of booking. Additions and Amendments
• If the Customer requires any additional services or variations prior to, or at the time the cleaning Service is being performed, Stradbroke Carpet & Upholstery Cleaning may agree to provide the additional services at an additional cost and at its discretion.
• If Stradbroke Carpet & Upholstery Cleaning suggests additional services or variations to the service prior to or at the time the cleaning service is being performed, Stradbroke Carpet & Upholstery Cleaning will seek permission from the Customer before undertaken any such services or variations.
Customer Representations and Warranties
• The Customer represents and warrants that:
• it will provide a safe working environment at the Service Site for the Service Worker to perform the Service;
• the Service Worker will have unencumbered and unobstructed access to those areas of the Service Site requiring the Service;
• the Service area will be unencumbered with furniture;
• it will provide the Service Worker with access to all services and utilities (including hot and cold water, electricity, a toilet for wastewater disposal and rubbish bins) as required by the Service Worker to provide the Service;
• it will advise Stradbroke Carpet & Upholstery Cleaning prior to the commencement of the Service of any hazards, slippery surfaces, risks or dangers.
• it is authorised to use the Service Site and obtain the provision of Service;
• it will complete the primary cleaning of Materials that have caused the soiling and/or staining of the Materials (e.g. vomit, food, faeces, garbage, organics, inorganics, etc.).
• it will secure or remove any fragile, delicate, breakable or valuable items, including cash, jewellery, works of art, antiques, or items of sentimental or monetary value prior to the commencement of the Service.
• it will ensure that all Materials to be cleaned are colour-fast, colour-stable, and will not be damaged by properly applied liquid extraction and/or deep brush vacuum cleaning.

Health and Safety Risks
• In addition to the obligations and warranties set out on the website www.stradbrokecarpets.com.au, the Customer acknowledges and agrees that:
• the Service Worker is entitled to undertake a job safety analysis before the commencement of any work to assess the health and safety risk at the Service Site; and
• the Service Worker may, either before or during the provision of the Service not provide or cease the provision of the Service where carrying out the Service presents, in the absolute discretion of the Service Worker, a risk to health and safety; and
• moisture on Materials can present a slip hazard, hence the Customer must not come into contact with any Materials that are being cleaned or have been cleaned until completely dry; and
• the Customer will ensure that any other guests, residents or contractors be aware of possible slip hazards, and must ensure they do not come into contact with any Materials that are being cleaned or have been cleaned until completely dry; and
• the Customer must agree to individuals and animals away from any equipment, chemicals, or hot water being used as a part of the Materials cleaning process; and
• the Customer must ensure that the environment that the Customer is inviting the Service Worker to work in, is a safe environment free from electrical or structural hazard; and
• cleaning solutions are poisonous, are not for human consumption, and are not to be handled by the Customer or any individuals or animals.
• Furniture and white goods relocation and removal is not provided as part of The Service offered Stradbroke Carpet & Upholstery Cleaning. Any furniture moving that is required can be managed as stated in section (Additions and Amendments). Delays to service caused by the need to manage furniture or white goods is subject to conditions set out under the section titled ‘Minimum Charges, Surcharges and Additional Fees’ found on the website www.stradbrokecarpets.com.au

Bookings
• The Customer may make a booking by telephone; all booking will be confirmed by the Service Worker or Stradbroke Carpet & Upholstery Cleaning.
• At the time of booking the Customer must provide details of any hazards, slippery surfaces, risks or dangers.
• If the Service required by the Customer falls outside the description of Cleaning Fees as listed on the website www.stradbrokecarpets.com.au, Stradbroke Carpet & Upholstery Cleaning will provide a job quotation at the time of booking.
• Stradbroke Carpet & Upholstery Cleaning reserves the right not to accept, or cancel, a booking for any reason.
• The time between booking and The Service may vary. Stradbroke Carpet & Upholstery Cleaning makes every effort to completed bookings as fast as possible.

Job Quotations
• The fees payable by the Customer are calculated from the Cleaning Fees prices found on the website www.stradbrokecarpets.com.au;
• If the Service required by the Customer falls outside the description of Cleaning Fees as listed on the website www.stradbrokecarpets.com.au, Stradbroke Carpet & Upholstery Cleaning will provide a job quotation at the time of booking.
• The price of any Cleaning Fees found on the website www.stradbrokecarpets.com.au, or quoted by Stradbroke Carpet & Upholstery Cleaning is an estimate only and is based on Stradbroke Carpet & Upholstery Cleaning's experience, without inspection, and based on information provided by the Customer.
• Any Cleaning Fees quoted by over the telephone to the Customer, or based on information found on the website www.stradbrokecarpets.com.au, and in the absence of specific room, or clearly definable descriptions will be based on standard room sizes/seating positions. If the actual Service to be performed is different to what has been quoted, or listed as Cleaning Fees, the price will be modified accordingly and at the discretion of Stradbroke Carpet & Upholstery Cleaning.
• The Service Worker may quote extra fees after inspection if there are extra rooms or areas that Stradbroke Carpet & Upholstery Cleaning were not informed of during the quotation process, or if the condition of the Materials are deemed to be different from the information provided by the Customer.
• Stradbroke Carpet & Upholstery Cleaning or the Service Worker will confirm the Cleaning Fees associated with the Service with the Customer before the Service commences.
• When the Service Worker arrives at the Service Site they will inspect the areas the Customer has requested to be cleaned.
• Maximum carpet / rug size applies for advertised or quoted pricing structures.
• Carpets / rugs less than 12 m2 are considered as 12 m2 for the purpose of Cleaning Fees.
• Cleaning Fees for carpets / rugs over 12 m2 are $5.00 m2 inclusive of pre vacuuming service.
• Upholstery cleaning prices are per seating position and are subject to the condition of the upholstery; additional charges may apply for recliners, ottomans, chaises and loose cushions.
• Coupons, discounts, specials, promotions and/or free services cannot be claimed by customers in combination; limited to one per customer or one per Service Site.
• Coupons, discounts, specials, promotions and/or free services cannot be applied to lower the minimum call out fee.

Stains
• The Service Worker will inspect the Materials and stains before the Service commences.
• Stains, including those derived from bleaching agents, acids and permanent dyes, or other stain agents may be permanent and cannot be removed.
• Neither Stradbroke Carpet & Upholstery Cleaning nor the Service Worker guarantees stain removal.
• Stradbroke Carpet & Upholstery Cleaning cannot be responsible for any pre-existing condition that is not apparent upon visual inspection of the Service Site.
• The Service Worker may deem it 'un-feasible' to remove a particular stain or mark when considered to the Service cost or method, or replacement.

Minimum Charges, Surcharges and Additional Fees
• The minimum charge for any Service is $60.00.
• A 25% additional surcharge applies to the cost of Services and Fees that take place after business hours (i.e. 5:00 pm) and public holidays.
• The Customer must book Stradbroke Carpet & Upholstery Cleaning Services 24 hours before the Service Time.
• If the Customer delays, suspends, postpones, forgets about, or cancels the Service for any reason, the Customer must provide prior notice to Stradbroke Carpet & Upholstery Cleaning that is 12 hours prior to the time that the Service is booked.
• In the event that the Customer does not provide said prior notice (as noted above) to Stradbroke Carpet & Upholstery Cleaning, the Customer agrees to pay a cancellation fee of $50.00.
• In the event that the Customer does not provide unencumbered access to the Service Site for Service by Stradbroke Carpet & Upholstery Cleaning, Stradbroke Carpet & Upholstery Cleaning reserves the right to cancel the booking; in this case the Customer agrees to pay a cancellation fee of $50.00.
• In the event that unencumbered access to the Service Site is not provided by the Customer after the Service Worker arrives at the Service Site, and the Service Worker waits at the Service Site, or is asked to wait at the Service Site by the Customer until unencumbered access is obtained, the Customer agrees to pay a delay fee of $60.00 per hour, prorated at $1.00 per minute, in addition to the cost of the Service. The Service Worker will not wait at the Service Site for longer than 60 minutes.
• Note that the Service Worker will call the Customer immediately if unencumbered access to the Service Site is not provided; a voice message and/or sms will be left for the Customer if the Customer does not answer the call made by the Service Worker. Delay fees begin to accrue after the call has been made to the Customer regarding the lack of unencumbered access.
• In the event that unencumbered access to the Service Site is not provided by the Customer after the Service Worker arrives at the Service Site, and the Service Worker is asked to wait at the Service Site by the Customer until unencumbered access is obtained, then the Customer either cancels the Service, or fails to provide unencumbered access, while the Service Worker is waiting at the Service Site, the Customer agrees to pay both the cancellation fee of $50 in addition to a delay fee of $60.00 per hour, prorated at $1.00 per minute.
• In the event that Customer fails to submit a completed Account Registration – Terms and Conditions Agreement Form, which results in the Service Worker waiting at the Service Site, the Customer agrees to pay a delay fee of $60.00 per hour, prorated at $1.00 per minute, in addition to the cost of the Service. The Service Worker will not wait at the Service Site for longer than 60 minutes. If while the Service worker is waiting, the Customer either cancels the Service, or refuses to submit a completed Account Registration – Terms and Conditions Agreement Form, the Customer agrees to pay both the cancellation fee of $50.00 in addition to a delay fee of $60.00 per hour, prorated at $1.00 per minute.
• The Service Worker reserves the right to end any waiting period at any time within 60 minutes, leave the Service Site, and Cancel the Service without notice to the Customer. In this case, the Customer agrees to pay both a cancellation fee of $50.00 in addition to a delay fee of $60.00 per hour, prorated at $1.00 per minute.
• The Service Worker reserves the right to decline any request to wait at the Service Site and Cancel the Service; in this case the Customer agrees to pay a cancellation fee of $50.00.

Payment Terms – Late Payment – Failure to make Payment
• Customers that have an account with Stradbroke Carpet & Upholstery Cleaning agree to pay for The Service within 5 business days of being sent an electronic invoice (pdf) to the nominated email address. The Customer must nominate, maintain, and check daily a valid email address from which to retrieve electronic invoices sent to the customer.
• If no payment has been made within the 5 business day time frame, Stradbroke Carpet & Upholstery Cleaning will use reasonable endeavours to contact the Customer for payment.
• Payments must be made by bank transfer or bank deposit to the following account:

• Where Stradbroke Carpet & Upholstery Cleaning has sent an electronic invoice the Customer for payment of fees, the Customer agrees to pay in full, all fees due, within 5 business days of the date that invoice was sent to the Customer. In the event that the customer has not made payment within the 5 business day time frame, the Customer must pay a $10 fee in addition to the outstanding account balance.
• The Customer agrees that if Stradbroke Carpet & Upholstery Cleaning has not received payment in full for the Service within one calendar month of the original date the invoice was sent to the Customer, then a late payment fee of $50 applies. Interest will then be charged at a fixed rate of 1 % of the outstanding account balance (principal + interest), compounded daily for each day the Customer account balance remains outstanding and unpaid.
• If the Customer’s account is outstanding for more than 3 months, Stradbroke Carpet & Upholstery Cleaning reserves the right to call-in at the Customer’s place of business to collect payment in person, in which case an additional $50 call-in fee will apply.
• Stradbroke Carpet & Upholstery Cleaning reserves the right to pass a Customer’s debt on to a collection agency and refer the Customers personal details to credit reporting agencies if the Customer’s account remains outstanding for more than 3 months. This action will incur additional charges to the Customer for the time, effort and expenses accrued by Stradbroke Carpet & Upholstery Cleaning as part of efforts to obtain payment by the Customer.
• In addition to the amounts set out above, the Customer agrees to indemnify Stradbroke Carpet & Upholstery Cleaning for all legal costs (on a solicitor and own client or full indemnity basis, whichever is greater) and other expenses incurred by Stradbroke Carpet & Upholstery Cleaning in connection with a demand, action, or other proceeding (including mediation, out of court settlement or any action taken for recovery of debt from the Customer) arising out of a breach of these terms including the failure by the Customer to pay an amount by the due date.
• Customers that DO NOT have an account with Stradbroke Carpet & Upholstery Cleaning agree to pay for the Service prior to or immediately upon the completion of the Service. • Payments made upon completion of the Service are to be made in cash only.
• Payments made prior to the Service must be by bank transfer or bank deposit to the following account:

• Failure to pay for the Service immediately upon the completion of the Service, then a failure to make payment fee of $50 applies.
• Interest will then be charged at a fixed rate of 1 % of the outstanding account balance (principal + interest), compounded daily for each day the Customer account balance remains outstanding and unpaid.
• If the Customer’s account is outstanding for more than 3 months, Stradbroke Carpet & Upholstery Cleaning reserves the right to call-in at the Customer’s place of work, home, or location of Service, to collect payment in person, in which case an additional $50 call-in fee will apply.
• Stradbroke Carpet & Upholstery Cleaning reserves the right to pass a Customer’s debt on to a collection agency and refer the Customers personal details to credit reporting agencies if the Customer’s account remains outstanding for more than 3 months. This action will incur additional charges to the Customer for the time, effort and expenses accrued by Stradbroke Carpet & Upholstery Cleaning as part of efforts to obtain payment by the Customer.
• In addition to the amounts set out above, the Customer agrees to indemnify Stradbroke Carpet & Upholstery Cleaning for all legal costs (on a solicitor and own client or full indemnity basis, whichever is greater) and other expenses incurred by Stradbroke Carpet & Upholstery.

GST
• Unless specified otherwise, all prices and quotations are expressed to be GST inclusive.

Complaints
• If the Customer is dissatisfied for any reason with the Service provided, it must inform Stradbroke Carpet & Upholstery Cleaning within 12 hours of completion of the Service. Stradbroke Carpet & Upholstery Cleaning strives to achieve customer satisfaction and will endeavour to resolve the problem quickly and efficiently.

Exclusions and Limitations
• The only conditions and warranties which are binding on Stradbroke Carpet & Upholstery Cleaning in respect of the state, quality or condition of goods and services supplied by Stradbroke Carpet & Upholstery Cleaning to Customers are those imposed and required to be binding by statute (including the Trade Practices Act 1974).
• To the extent permitted by statute, the liability, if any, of Stradbroke Carpet & Upholstery Cleaning is, at Stradbroke Carpet & Upholstery Cleaning’s option, limited to and completely discharged by the resupply of the Service. Stradbroke Carpet & Upholstery Cleaning is not responsible for:
• not completing or providing the Service as a result of a breach of a warranty by the Customer as set out on the website www.stradbrokecarpets.com.au (including a failure by the Customer to provide utility services, a safe working environment or unencumbered access to the Service Site); or
• not completing or providing the Service as a result of the Service Worker not proceeding for health and safety reasons as stated on this website (www.stradbrokecarpets.com.au; or
• any loss or damage incurred by the Customer or any third party as a result of the effects of a force or nature or act of God, being any event beyond the reasonable control of Stradbroke Carpet & Upholstery Cleaning; or
• not completing or providing the Service due to an act or omission of the Customer or any other person at the Service Site during provision of the Service; or • wear, damage or stains that cannot be completely cleaned or removed;
• any wear or discolouring of fabric or surfaces becoming more visible once dirt has been removed, or as a result of the Service;
• any loss incurred as a result of any breakage or damage to Materials, goods, items of value (including antiques, items of sentimental or monetary value) or the Service Site; or
• the cost of any key replacement or locksmith fees, unless said keys were lost after they were in the physical possessions of Stradbroke Carpet & Upholstery Cleaning or the Service Worker.
• Except as provided in this clause, all conditions and warranties implied by law in respect of the state, quality or condition of the Service which may apart from this clause be binding on Stradbroke Carpet & Upholstery Cleaning are excluded.
• The Customer acknowledges that the results of any services provided may vary depending on a number of factors (including time elapsed since the Service Site Materials were last cleaned and nature of Materials that required cleaning), and that Stradbroke Carpet & Upholstery Cleaning gives no guarantee as to the actual results of the Service.
• Except to the extent provided in this clause, Stradbroke Carpet & Upholstery Cleaning has no liability (including liability in negligence) to any person for any loss or damage, consequential or otherwise, suffered or incurred by that person in relation to the products or services provided by Stradbroke Carpet & Upholstery Cleaning (including any loss caused by, or resulting directly or indirectly from, any failure, defect or deficiency or any kind of or in the products used or services provided by Stradbroke Carpet & Upholstery Cleaning).

Indemnity
• The Customer indemnifies Stradbroke Carpet & Upholstery Cleaning against:
• all losses or liabilities arising directly or indirectly as a result of the provision of the Service including all losses or liabilities caused as a result of a breach of the warranties of the Customer set out on website www.stradbrokecarpets.com.au; and
• all legal costs (on a solicitor and own client or full indemnity basis, whichever is greater) and other expenses incurred by Stradbroke Carpet & Upholstery Cleaning in connection with a demand, action, arbitration or other proceeding (including mediation, compromise, out of court settlement or appeal and including any action taken for the recovery of a debt from the Customer).

Accidents, Breakage, Damage & Theft
• The Customer must inform Stradbroke Carpet & Upholstery Cleaning of any incident where an accident, breakage, damage to property or theft has occurred due to any act of the Service Worker within 12 hours of completion of the Service.
• To the extent permitted by law, the Customer is not entitled to claim any loss for any incident if the incident is not reported to Stradbroke Carpet & Upholstery Cleaning within 12 hours of completion of the Service.
• To the extent permitted by law, damage or loss to the following items is specifically excluded from the liability of Stradbroke Carpet & Upholstery Cleaning under these terms and conditions: cash, jewellery, art, antiques, and items of sentimental and monetary value.

Termination
• This Agreement may be terminated by the Customer by providing at least 24 hours notice prior to the next scheduled Service.
• Stradbroke Carpet & Upholstery Cleaning may terminate this Agreement and cancel Service with immediate effect at any time without prior notice.

Changes to this Agreement
• Stradbroke Carpet & Upholstery Cleaning reserves the right to update or modify these terms and conditions at any time without prior notice, and may do so by publishing an updated agreement on the Stradbroke Carpet & Upholstery Cleaning Carpet Cleaning website (www.stradbrokecarpets.com.au).
• Each updated or modified agreement will take effect immediately after it has been published on the website www.stradbrokecarpets.com.au.
• The Customer agrees that any use of the Service following any such change, whether as a single job or as part of a regular Materials cleaning schedule, constitutes their agreement to follow and be bound by the terms and conditions as changed.

Law & Jurisdiction
• The Customer and Stradbroke Carpet & Upholstery Cleaning acknowledge and accept that this Agreement shall be construed and interpreted in accordance with the laws of Queensland and both agree to submit to the exclusive jurisdiction of the courts of Queensland in the event of any dispute.

Severability
• The Customer agrees that if any term or provision is held invalid, void or unenforceable, then that provision will be considered severable and the remaining terms and provisions shall continue to be binding.

Customised Essential Oil Pre-Spray Preparation and Application (oils or substances provided by the customer)
• In addition to the terms set out in the Exclusions and Limitations section of this website:
• The Customer takes full responsibility for any impacts that any oil or substance has upon the Materials and the environment and living organisms as part of the Service; and
• Stradbroke Carpet & Upholstery Cleaning does not make any recommendations or guarantees with respect to any oil or substance used as part of the Service, and
• Stradbroke Carpet & Upholstery Cleaning takes no responsibility for the quality or composition or impact of any oil or substance; and
• The customer is responsible for any damages that any oil or substance causes to the Service Worker, and/or Cleaning equipment used, as part of the service; and
• The Service Worker can refuse to use any oil or substance provided by the Customer for any reason.

Free Pre-Vacuum Demonstration
• Only upon request by the customer are customers are eligible for a single, one-time only, free pre-vacuum demonstration.
• The customer must be present to view the demonstration.
• Limit one per customer or one per Service Site.
• The demonstration is limited to a 1m2 section of non-shag carpet.
• The demonstration is not a stand-alone offer; and is offered only in conjunction with a Materials Cleaning Service.
• The demonstration cannot be claimed in conjunction with any other promotion, coupon or discount.
• The Service Worker reserves the right to choose which carpet, the section of carpet, and the amount of time taken to perform the demonstration.
• The Service Worker reserves the right to not undertake the demonstration for any reason.
